Terms and Conditions
1. Hire Fees: The Hirer agrees to pay RHINO SOUND AND LIGHTING the specified Hire Fees for the Equipment from the commencement to the conclusion of the rental period, as outlined in the Equipment Hire Invoice. The charge is for the entire duration of the rental, not solely for the duration of usage. The minimum rental period is 24 hours.
2. Security Deposit (Bond):
The Hirer may be required to provide a security deposit, payable in cash or via bank transfer, before renting Equipment. This deposit may be utilized by RHINO SOUND AND LIGHTING to cover any overdue fees, additional charges, or as compensation for lost, stolen, or damaged Equipment. The Hirer’s liability for any such incidents extends to the full replacement cost of the Equipment, not limited to the bond amount.
3. Insurance:
The Hirer is responsible for arranging their own insurance covering the full value of the Equipment against loss, theft, or damage throughout the rental period. RHINO SOUND AND LIGHTING does not provide insurance coverage. The Hirer bears 100% responsibility for any costs associated with repairing, replacing, or compensating for damaged, lost, or stolen Hire Equipment.
4. Use of Equipment:
The Hirer agrees to utilize the Equipment solely for its intended purpose and as agreed upon at the time of rental. Negligent, unskilled, or improper usage, or usage inconsistent with the Equipment’s design, may result in damage or loss for which the Hirer is liable. Upon return, all Equipment will undergo testing and inspection. The Hirer is liable for any non-functional or damaged Equipment, subject to full replacement or repair costs determined by RHINO SOUND AND LIGHTING.
5. Delivery & Setup:
RHINO SOUND AND LIGHTING does provide delivery and setup services for the Equipment. The Hirer is responsible for the setup environment. Equipment will be collected at a mutually agreed-upon time. Late pickup may incur additional fees.
6. Payment:
All fees must be settled in advance. The Hirer agrees to provide complete contact information and proof of address. Any incurred additional costs, including delivery charges and late return fees, must be promptly settled by the Hirer.
7. Ownership of Equipment:
The Equipment remains the property of RHINO SOUND AND LIGHTING at all times. The Hirer is prohibited from selling, transferring, lending, or otherwise disposing of the Equipment. If the Equipment is sub-rented, the original Hirer remains responsible for its condition and return.
8. Cleaning:
Before returning the Equipment, the Hirer must ensure the equipment is clean. Failure to meet cleaning obligations may result in cleaning fees charged by RHINO SOUND AND LIGHTING, which may be deducted from the Hirer’s deposit.
9. Breakdown:
In case of Equipment malfunction during the rental period, the Hirer must promptly notify RHINO SOUND AND LIGHTING and refrain from attempting repairs without authorization. Immediate notification of breakdowns is required via phone/SMS to RHINO SOUND AND LIGHTING’s emergency number, 0434 794 695.
10. Liability:
To the extent permitted by the Australian Consumer Law, RHINO SOUND AND LIGHTING bears no liability for any loss or damage arising directly or indirectly from Equipment rental. RHINO SOUND AND LIGHTING’s liability, if any, is limited to refunding the Hire Fees for the affected Equipment. The Hirer indemnifies RHINO SOUND AND LIGHTING from any liability, losses, damages, claims, demands, or expenses arising from this Equipment Hire Contract.
11. Reservations, Cancellations & Returns:
Cancellations made within 14 days of the hire date incur 50% of the total hire charges. Cancellations within 24 hours or no-shows result in a 100% charge. Failure to return Equipment on the due date incurs daily hire charges. If Equipment is not returned within 3 business days, RHINO SOUND AND LIGHTING may charge for Equipment replacement at their discretion.
12. Termination:
RHINO SOUND AND LIGHTING reserves the right to terminate the Equipment Hire Contract immediately in the event of Hirer breach.
13. Free of Charge Issue:
Even when Equipment is provided free of charge, these terms and conditions apply.
14. General:
RHINO SOUND AND LIGHTING reserves the right to amend the terms and conditions of this Equipment Hire Contract at any time.
Acknowledgement:
By accepting the Equipment, the Hirer acknowledges its undamaged, operational condition. The Hirer agrees to report any damages or malfunctions immediately and understands their responsibility to return all Equipment in a clean state.
